These terms govern your use of the TeslaKee mobile application (“the App”) provided by toothR new media GmbH, Urstein Süd 15, 5412 Puch, Austria.

1. What TeslaKee is

TeslaKee is an independent application that acts as a Bluetooth phone key for compatible Tesla vehicles, and that applies access rules you configure before it authorises entry.

TeslaKee is not affiliated with, endorsed by, or sponsored by Tesla, Inc. Tesla is a trademark of Tesla, Inc. We have no control over your vehicle, its firmware, or any change the manufacturer makes to it.

2. Requirements

To use the App you need a compatible Tesla vehicle, a supported smartphone with Bluetooth, and the ability to enrol a key at the vehicle using your own Tesla key card. You must be authorised to access any vehicle you enrol with.

3. What TeslaKee cannot promise

Please read this section carefully.

TeslaKee is a convenience and security tool. It is not a guaranteed means of access to your vehicle. It depends on Bluetooth connectivity, on your phone’s operating system granting the App permission to run in the background, on your phone having battery, and on your vehicle behaving as expected. Any of these can fail for reasons outside our control.

Always carry an independent means of access — your Tesla key card or the manufacturer’s own app. Do not rely on TeslaKee as your only way into your vehicle.

The anti-relay rules reduce the risk of a relay attack against your phone key. They do not eliminate that risk, and they do not protect against attacks on your vehicle, your vehicle manufacturer account, or your phone itself.

4. Liability

To the maximum extent permitted by applicable law, toothR new media GmbH is not liable for any inability to access your vehicle, for unauthorised access to your vehicle, or for any loss or damage arising from your use of the App.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Consumers retain all mandatory rights under Austrian and EU consumer law.

5. Subscriptions

Some features require a subscription, purchased through the app store you installed the App from. We never receive or process your payment details.

• Payment is charged to your app store account at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Renewal is charged within 24 hours of the end of the current period.
• You can manage and cancel subscriptions in your app store account settings. Deleting the App does not cancel a subscription.
• Refunds are handled by the app store under its own policy.

6. Acceptable use

Use TeslaKee only with vehicles you are authorised to access. You may not use the App to attempt access to a vehicle that is not yours or that you do not have permission to use.

7. Privacy

TeslaKee processes access decisions on your device. See the App Privacy Policy for what is stored on your device and the one case in which data is transmitted.

8. Changes to these terms

We may update these terms. Material changes will be announced in the App and in its release notes. Continued use after a change constitutes acceptance.

9. Governing law

These terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer, you also retain the protection of mandatory provisions of the law of your country of residence.
